This Atom Finance Premium Sneaker Giveaway Sweepstakes (“Sweepstakes”) is open to all natural persons who are legal residents of the 50 United States and District of Columbia, who are at least 18 years old at time of entry (each, and “Entrant”). Void outside the USA, in Puerto Rico, the US Virgin Islands, and other United States territories and protectorates. The Sweepstakes is further subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.

The Sweepstakes sponsor is Atom, with offices at 425 Broadway, Fl 3, New York, NY 10013. Sponsor and its respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, including without limitation, the immediate family members of such individuals, are not eligible to participate. Sponsor will conduct the Sweepstakes substantially as described in these Official Rules.

This Sweepstakes begins on March, 1 2021 at 12:01 AM EST and ends on March 31, 2021 at 11:59 PM EST (“Entry Period”)

During the Entry Period, Atom users with Atom Premium accounts will be automatically entered into the Sweepstakes. Users must be enrolled in the Atom Premium plan on March 31, 2021 to be eligible. Users must also have an account in good standing. No purchase necessary: If an Entrant would like to enter the contest without being an Atom Premium user, they may fill out the form here and mail it to Atom Finance, Attn: Sweepstakes, 425 Broadway, Fl 3, New York, NY 10013. Purchasing Atom Premium will not increase chances of winning the Sweepstakes.

By entering the Sweepstakes, entrants agree to participate in any media or promotional activity resulting from the Sweepstakes as reasonably requested by Sponsor at Sponsor’s expense and agree and consent to use of their name, identifying information and/or likeness by the Sponsor. Sponsor will contact Entrants in advance of any Atom-sponsored media request for interviews.

Sponsor reserves the right to publish the name and likeness of Entrants, whether or not such Entrants were winners. Entrants waive any rights to assert any intellectual property rights to any submissions, and grant a perpetual, non-exclusive, royalty-free license to their name, identifying information and likeness worldwide within the scope and according to these Official Rules and to comply with notice and legal obligations.

LIMIT ONE ENTRY PER PERSON.. No third party entry or entry through any sweepstakes service is permitted. Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, as determined by Sponsor, will be disqualified. Use of robotic entry devices is strictly prohibited.

One (1) Grand Prize will be awarded, which consists of: one (1) pair of custom sneakers. Winner agrees to accept the Grand Prize “as is” and entrants hereby acknowledge that neither Sponsor nor Administrator is in any manner responsible or liable for any warranty, representation, or guarantee relative to the Grand Prize, including warranties provided exclusively by a prize supplier. Approximate retail value of the Grand Prize is $235. Any difference between stated approximate retail value and actual value of Grand Prize will not be awarded. Winner is solely responsible for any federal, state, and local taxes. Winner must provide Sponsor with a valid Social Security number or taxpayer identification number before prize will be awarded. Winners will be selected in a random drawing from among all eligible entries collected during the Entry Period taking place on or about April 9, 2021, at Sponsor’s principal place of business. The drawing will be conducted by Sponsor, whose decisions and interpretations on all matters relating to the Sweepstakes and these Official Rules are final and binding in all respects. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is not eligible or has violated the Official Rules, gained unfair advantage in the Sweepstakes, or obtained winner status using fraudulent means. If there is a dispute about the identity of an entrant, prize will be awarded to the natural person to whom the email address is assigned by the internet service provider responsible for the domain associated with the submitted email address. If winner is found to be ineligible or not in compliance with the Official Rules, winner will be disqualified and an alternate winner will be awarded the prize in a separate random drawing. Winner will be notified by telephone. Inability of Sponsor to contact winner by telephone within seventy two (72) hours after selection may result in disqualification of winner, and an alternate winner may be selected in a random drawing at Sponsor’s discretion. Prize will be sent to winner by U.S. mail within fourteen (14) days after winner has been notified and accepted the prize. If prize is returned as undeliverable, then prize will be forfeited and another winner will be randomly drawn.

The odds of winning will depend on the number of eligible entries received, according to the eligibility requirements in the Sweepstakes.

Any deliberate attempt to tamper with, damage, or undermine the legitimate operation of the Sweepstakes by an Entrant may be subject to legal penalties, and Atom reserves the right to seek damages from any such Entrant to the fullest extent of the law. All disputes between Entrants and Atom of any kind whatsoever arising out of the Sweepstakes or these Official Rules, shall be submitted to Judicial Arbitration and Mediation Services, Inc. ("JAMS") for binding arbitration under its rules then in effect in New York City, New York, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred. To the maximum extent permitted by law, the maximum liability of the Sponsor shall not exceed the cost of the Sweepstakes price, regardless of the total number of claims by an Entrant, whether brought in the same action or multiple actions.
